At least 2 of 4 people accused of murdering Damian Daughtry in Fayetteville on Aug. 31 could get the death penalty.
In a hearing on Friday, prosecutor Cal Colyer announced that the state intends to seek capital punishment for Tony Truesdale of Durham and Edward Wayne Burnette of Pittsboro.
Similar hearings are to be held to announce whether prosecutors will seek execution for the other defendants Melissa Jeaneane Riggsbee of Orange County and Hubert Joseph Riggsbee of Durham.
The case
Court documents say the 4 defendants conspired to and tried to steal $2,000 worth of marijuana and cash from Martonias Crump in his apartment on Willowbrook Drive.
The documents say that Burnett was armed with a shotgun, and Daughtry, who tried to help Crump, had a handgun.
During a struggle, documents say, Daughtry dropped his gun and Crump grabbed it and shot Truesdale in the thigh. Daughtry was shot in the back with the shotgun, records say.
D.W. Bray, who represents Truesdale, disagrees with the portrayal that this was a botched robbery. He said that a fight broke out and guns were drawn because the people did not trust each other.
"It was just an illegal exchange between 2 parties that went bad," Bray said. "It almost appears by mere accident the victim in the case got shot by a shotgun."
