A Bucks County judge ruled yesterday that a Philadelphia man with a low IQ is not legally mentally retarded and is eligible for the death penalty.
Judge Kenneth G. Biehn found that although David Carmichael, 29, has an IQ below 70, which is commonly considered retarded, he has been able to adapt and function. Carmichael, his brother Matthew, 24, and friend Allan Dillard, 22, who is borderline mentally retarded, could get the death penalty when they are sentenced today for the May 12, 2005, slayings of Wayne Denno, 47, and his wife, Carol, 44.
The Carmichaels' brother Carlos pleaded guilty to 3rd-degree murder and faces a possible 6- to 20-year sentence.
