Solicitor will evaluate Souers case for death penalty
The solicitor handling the prosecution of Jerry Buck Inman in the Tiffany Marie Souers murder said today he will evaluate its potential as a death-penalty case after he gets the case file from investigators.
Thirteenth Circuit Solicitor Bob Ariail said in a news release that state law requires there to be certain aggravating circumstances accompanying a murder charge for the death penalty to be allowed.
2 qualifying circumstances are criminal sexual conduct in the 13st degree and kidnapping, both of which might apply in the Souers case, Ariail said.
"We must have the case file from law enforcement before a review can be made," he said.
That could be within a month, he said. His final decision will be made after discussions with his staff, investigators and the Souers family, he said.
